‘Loan sharks’ caught at ATM with over 200 Sassa cards

Unscrupulous lenders take Sassa cards from desperate people for loan payments.
Two alleged loan sharks were arrested after they were seen at a cash machine at the Thabong Mall in Sebokeng passing through card after card to get cash out.
They were spotted by community patrollers from the Gauteng department of community safety, who alerted the police.
According to the department’s Ofentse Morwane: “The suspects were seen withdrawing cash using various Sassa cards at an ABSA machine near the Spar supermarket at the mall.”
“The suspects are believed to be loan sharks who took Sassa cards from their owners.”
The use of Sassa cards as collateral for loans appears to be on the rise.
Earlier this week, Tshwane metro police arrested seven people for alleged Sassa card fraud, seizing 91 Sassa cards and R191,671 in cash.
The payment system has been plagued by glitches during the lockdown, with many people being unable to receive their money on time.
Long queues and social distancing have contributed to the payment woes.

This is what South Africa’s lockdown means for school fees

With South Africa’s schools closed for more than six weeks due to the coronavirus lockdown, and no firm outline for when they will return, questions are being raised around the issue of school fees.
On 30 April, minister of Basic Education Angie Motshekga urged parents to continue paying school fees as normal to ensure that teachers receive their salaries.
However, the question is whether or not parents are expected to pay the full school fees even though their children are not physically attending school and not benefitting from the schooling experience – which includes social interaction, play and sports and recreation, says law firm Werksmans.
In the same vein, what are the rights of schools to enforce the payment of fees in the circumstances?
Legislation
Werksmans said that the governing legislation for schools is the South African Schools Act which distinguishes between public and independent schools.
“Public schools perform the constitutional function of providing basic education in terms of section 29(1) of the Constitution,” it said.
“As such, the Schools Act prohibits the refusal of admission, suspension or expulsion of a learner due to the non-payment of school fees in order not to deprive learners of their right to basic education.”
Werksmans noted that in terms of section 40 of the Act, parents of learners in public schools are liable for school fees, but can be exempted from the payment of school fees to the extent that they are unable to pay.
“Depending on whether a parent has suffered a reduction in salary or has become unemployed, the exemption may be partial or full.
“According to a statement made by the Western Cape Education Department, where parents have been rendered unemployed due to the national lockdown, they should apply to the head of the School Governing Body for exemption from fees in terms of section 40.
“Nevertheless, parents have been urged by various stakeholders to continue paying school fees to cover the salaries of teachers.”
Private schools
Independent or private schools do not provide the same constitutional function as public schools, and instead have contractual relationships with the parents of learners.
As such, independent schools have more extensive remedies at their disposal to enforce the payment of school fees, said Werksmans.
The firm cited the case of St Charles College v Du Hecquet De Rauville, in which the KwaZulu-Natal Division of the High Court confirmed the principle of ‘informed choice’.
This dictates that parents exercise a discretion to send their children to independent schools because they enjoy a higher economic status than the majority of parents who choose to send their children to public schools.
“The case confirmed that the immovable property of parents is executable for payment of arrear school fees,” Werksmans said.
“Further, in AB and Another v Pridwin the Supreme Court of Appeal that private schools have the right to terminate their contractual relationships in the event of a material breach.
“Depending on the terms of each contract, failure to pay school fees may constitute such a breach. Schools would then be entitled to prevent students from returning to school.”
What if you can’t pay?
Werksmans said that in the case of NM v John Wesley School, the KwaZulu-Natal Division of the High Court emphasised that when independent schools enforce their contractual rights in recovering arrear payments or want to exclude learners, they must always be cognisant of the best interests of the child standard.
Schools must enquire into the reason for the default on fees and make a reasonable decision which will minimise any adverse effect on a learner’s education.
“Considering the ongoing situation regarding Covid-19 and its effect on the economy and the livelihoods of many South Africans, schools should be careful not to appear draconian in the enforcement of their contractual rights in the face of the possible economic hardship of parents,” Werksmans said.
“Schools should consult with parents and attempt to settle the outstanding fees or make provision for alternative repayment terms before considering the exclusion of a learner.”
Where parents become unemployed or it becomes unreasonably difficult for them to pay their school fees, they may rely on the contractual principle of supervening impossibility of performance, the firm said.
“If a school contract contains a material adverse change clause, parents may rely on that clause to justify non-performance of their contractual obligations to pay school fees.
“However, such a clause may only be invoked in specific circumstances. Even if there is no clause, the common-law principle of vis maiormay apply where performance has become objectively impossible or so onerous that it would be unreasonable to expect a party to perform.”
However, such disputes will always need to be decided by a court, taking into account all the relevant and surrounding circumstances, Werksmans said.
Current position
In conclusion, Werksmans said that parents have been encouraged to continue paying their school fees wherever possible.
“In a situation where it becomes impossible for parents to pay, the first step should always be mutual engagement between parents and schools.
“Parents in public schools may be granted exemptions in terms of the Schools Act. It is advisable that parents obtain legal advice before attempting to rely on vis maior or material adverse change clauses.”
However, in enforcing their contractual rights, independent schools must be careful to minimise any adverse impact on learner’s rights and seek settlement routes before considering more litigious options, Werksmans said.
“Covid-19 has not only brought to the fore various “new normals” in virtually all areas of life, but it has also accentuated the glaring stubborn inequality in South African society and in particular the interconnectedness between the right to education and access to data.”

Uzalo off screens for a month, despite cast and crew returning to set

‘Uzalo’ cast members returned to work this week, but the show will be taking a break.
The cast and crew of SABC1’s hit soapie Uzalo returned to work this week, but it isn’t enough to stop the show going off air for a month-long break.
Uzalo confirmed in a statement that Friday’s episode will be its last until June 15.
The show said that production was “profoundly affected” by the national lockdown, resulting in the show “not having enough material to flight”.
“It is important to us to ensure we deliver content that adheres to the Covid-19 protocols, safeguarding our active cast, crew and greater community” it added.
Last month the SABC confirmed that Uzalowould run out of episodes due to the national lockdown.
“The SABC can confirm that due to the production of SABC1’s popular series Uzalo being halted as a result of the lockdown, unfortunately there is limited stock for this particular programme,” said acting spokesperson Mmoni Seapolelo.
Meanwhile, actress Baby Cele has given fans a glimpse of life on set in the wake of the coronavirus pandemic.
In a short video posted to Instagram this week, Baby wears a face shield while a crew member prepares her for set, dressed in a protective clothing from head to toe.
Another member of the team can be seen wearing a cloth face mask, while a child wears a similar shield.

Over 500 health workers tested positive for COVID-19 – Mkhize

JOHANNESBURG – Health Minister Dr Zweli Mkhize on Wednesday said more than 500 health workers had tested positive for COVID-19.
Mkhize said 26 health workers were hospitalised and two of them, a doctor and a nurse, had died.
In addition, 149 health workers had recovered.
The minister was speaking in Rustenburg where he received personal protective equipment from Sibanye-Stillwater and Old Mutual as miners returned to work under level 4 lockdown regulations.
“We have a total of 511 health workers who have tested positive, 26 of them are hospitalised and we have lost two of them – a doctor and a nurse. One hundred and forty nine health workers have recovered. The contribution of the protective gear is therefore very important,” the minister said.

Meanwhile, Mkhize said he was contacted by the Madagascar government who asked South Africa for help with scientific research on looking at herbs to help fight COVID-19.
He said South Africa was not there yet.
“We received a call from the government of Madagascar who asked for help with scientific research. Our scientists would be able to assist with this research. We will only get involved in a scientific analysis of the herb, but we are not at that point yet,” he said.

Nandi Madida and Zakes Batwini’s adorable 3-year-old son already has his own farm. The singer posted a beautiful video of him where he can be heard saying, “This is from my farm, yeah, that’s my farm.
” The cute boy then starts to sing the ‘Old McDonald had a farm’ song. The star, who rarely blesses her followers with pictures and videos of her children, melted their hearts by sharing the video.
Nandi revealed that she bought her son land as his birthday gift and have since built a farm, where he grows amadumbe, which is also known as ‘potato of the tropics’. In the picture and accompanying video, Shaka was all smiles and certainly looked very proud of his amadumbe. Nandi wrote, “These are my son, Shaka’s, amadumbe from his farm in KZN.
It has always been a dream of mine (and my ancestors) that, one day, when I have children, that they have their own farms and generational wealth that aligns with all things good and Godly.
That they can pass on to their own children and so on and, most importantly, share with the village. My son does (this) with the help of my incredible mother and the inspiring farm workers.”
Nandi and Zakes are spending quality time at home with their two kids during lockdown, which her birthday fell on. They also shared cute videos of themselves bonding as a couple.
